Complaints Not Subject to the UCP

Any complaint alleging barriers to accessing District programs, services, activities, and facilities under the Americans with Disabilities Act and/or Section 504 of the Rehabilitation Act of 1972.

What is a Charter School Enrollment Complaint? Under the California Education Code (EC) Section 47605(d)(4), a charter school shall not discourage a pupil from enrolling or seeking to enroll, shall not request a pupil's records before enrollment, and shall not encourage a pupil currently attending to disenroll or transfer to another school for any reason (except for suspension or expulsion).

To submit a complaint regarding concerns described in the Enrollment Complaint Notice, please complete the Charter School Complaint Form and submit the form to the CLCS Board, electronically or in hard copy, to the following location:

Complaints regarding Child Nutrition Programs must be addressed through the existing procedures outlined in the federal regulations and the related state regulations California Code of Regulations, Title 5, Sections at 15580 through 155884. Complaints may be submitted to the Nutrition Services Division (NSD) by contacting the Civil Rights and Complaints Coordinator by phone at 916-323-5264 or by email at cnpcomplaints@cde.ca.gov.

Complaints regarding employment discrimination or harassment shall be investigated and resolved in accordance with policies relating to Nondiscrimination in Employment.

Any complaint alleging disagreement with decisions or actions taken or not taken in regards to a student's Section 504 evaluation or plan.

Any complaint alleging CLCS violation of applicable state or federal law or regulations governing special education, including Due Process and FAPE concerns, should be filed with the Department of Education.

What is a Williams Complaint? Under state law, learners, parents and staff can submit complaints concerning deficiencies related to instructional materials, conditions of facilities that are not maintained in a clean or safe manner or in good repair, and teacher vacancy or mis-assignment. These are called "Williams Complaints."

CLCS Williams Complaint Procedures shall be used to investigate and resolve any complaint related to sufficiency of textbooks or instructional materials, emergency or urgent facilities conditions that pose a threat to the health or safety of students or staff, or teacher vacancies and mis-assignments.

All Williams Complaints should be filed with the Lead Facilitator at the school site to which the complaint pertains.
